The purpose of this policy is to inform you about how we process your personal information, what we use it for, who may have access to it and under what conditions, as well as how you can exercise your rights.

What is personal information?

Personal information refers to all data that can be directly or indirectly attributed to a living physical person. Energy Save is committed to protecting your personal information and therefore processes it only in accordance with the General Data Protection Regulation (EU) 2016/679 and other relevant legislation.

We are the data controllers

ES Energy Save Holding AB, with registration number 559117-1292 and address Nitgatan 2, 441 38 Alingsås, is responsible for the personal information processed about you. Therefore, Energy Save, or any of the subsidiaries within the same group, is the data controller for your personal information.

Why do we process personal information about you?

We process your personal information to provide you with our services and products, i.e., solely to enter into or fulfil an agreement with you as a customer or collaborator.

What information do we collect about you – and why?

We aim to process as little personal information about you as possible. This means that we do not collect more personal information than necessary to enter or fulfil agreements with you. To enter and fulfil agreements with you, we need information such as first name, last name, email address, address, and other contact details. We do not have access to your personal information in any other way than through your provision of the information to us. If you have not given us your consent, we will not use your personal information for marketing purposes.

How do we protect your personal information?

Your security is important to us. Therefore, we have implemented appropriate technical, organizational, and administrative security measures to protect your personal information from unauthorized access and other unlawful processing. We regularly analyse and evaluate these measures to ensure that the protection of your information is as secure as possible.

We do not disclose your information to other companies or organizations unless required by law or necessary to fulfil our legal or contractual obligations towards you. We may disclose your personal information to some of our partners, suppliers, or subcontractors, but only if necessary to fulfil our obligations to you as a customer or collaborator. We never disclose more personal information than necessary. When required by law, we may need to disclose your information to authorities and other organizations. We may also need to disclose your information if necessary to exercise, establish, or defend our legal claims. We never disclose your personal information to other companies or entities for marketing purposes.

Transfer to third countries

In cases where personal information may be transferred to a country outside the EU/EEA, it is done in accordance with applicable data protection legislation and requires that the country in question has an adequate level of protection or that there are other sufficient safeguards that make the transfer lawful, such as the use of so-called standard contractual clauses. Occasionally, transfers to third countries may occur if necessary to fulfil an agreement or if Energy Save engages a different type of service provider, such as a data processor, outside the EU or EEA. You always have the right to withdraw your consent at any given time.

On what legal basis do we process personal information about you?

We only process the personal information we need in order to perform our services or deliver our products to you, i.e., when we enter into or fulfil agreements with you. To the extent that we process additional information, we will obtain your consent or ensure that the processing is permitted under another legal basis.

Energy Save may obtain information from, and provide information about you to, third parties such as credit reporting agencies, authorities, and trading platforms. You will receive information about which third parties the information may be provided to/obtained from in connection with the current processing.

How long do we process your personal information?

Energy Save does not retain personal information for longer than necessary regarding the purpose of the processing. The personal information is stored for as long as the contractual relationship lasts and thereafter for a maximum of ten years in consideration of prescription rules. In some cases, the data may, however, be kept for a longer period due to legislative requirements.
